Terms and Conditions

1. Scope

These Terms and Conditions apply to all purchases made through the online store mobpicker.eu, operated by BATUBERG Sp. z o.o. in the version valid at the time the order is placed.

2. Conclusion of Contract

By placing an order on our website, the customer submits a binding offer to purchase.

A contract is concluded when BATUBERG Sp. z o.o. confirms the order by email or dispatches the goods.
We will confirm acceptance within two business days.

Business days are all calendar days in Poland except weekends and public holidays.

Polish public holidays include:
1 January, Easter Sunday & Monday, 1 May, 3 May, Corpus Christi, 15 August, 1 November, 11 November, 25 December, 26 December.

Warehouse logistics may also observe holidays in:
• Lithuania (16 February, 6 July, etc.)
• France (1 Jan, 1 May, 14 July, 25 Dec, etc.)

3. Delivery, Shipping Costs, Transfer of Risk

Shipping costs are shown at checkout.

For consumers, risk passes only upon delivery.
For business customers, risk transfers once goods are handed to the logistics provider.

4. Retention of Title

Goods remain the property of BATUBERG Sp. z o.o. until fully paid.

5. Payments

Only payment methods displayed during checkout are accepted.

6. Liability for Defects

Statutory Polish consumer protection laws apply.

• New goods — full statutory liability.
• Used goods — liability for consumers limited to 1 year; excluded for business customers.
• Liability for injury to life, body, health, and product liability laws remain unaffected.

7. Consumer Information in Distance Selling

a) Input errors can be corrected using website editing functions prior to submitting the order.
b) Product characteristics and validity of limited offers appear in item descriptions.
c) Contract languages: English, Polish, and/or applicable language of your selection.
d) Complaints may be submitted to the contact information listed on the website.
e) We do not store the contract text; customers should save order confirmations.
f) Payment, delivery, and service details are shown in the product offer.

8. Dispute Resolution

We are not legally obliged to participate in consumer arbitration processes, but we may do so voluntarily.

9. Governing Law

The contractual relationship between the customer and BATUBERG Sp. z o.o. is governed by the laws of Poland.

Consumer protection laws of the customer’s country of residence remain unaffected.

The UN Convention on Contracts for the International Sale of Goods does not apply.

Customer data is processed strictly for contract fulfilment and lawful purposes.
